1. registration

By registering, the customer offers to conclude a contract with the organizer. Registration for the event can only be made in writing using the registration form. Once you receive the registration confirmation, the registration becomes binding.

2. services and prices

The prices and the services of the organizer included in the price result from the respective tenders according to the offer. Services not specified are not included. The organizer reserves the right to make minor changes regarding the course of the event.

3. minimum participants

The minimum number of participants for the event is 6 people. The organizer reserves the right to cancel an event even at short notice if this minimum number of participants has not been reached. We will inform you immediately in this case and, if necessary, the participant will be fully refunded the event fee. Further claims are excluded.

4. terms of payment

Once you have received the registration confirmation, a deposit must be paid within one week. This amounts to 50% of the total amount. The application will be accepted only if this condition is met. The balance on the total price is to be paid on the spot.

5. provision and laws

Of course, the participant has to take care of the compliance with laws, such as passport, customs and visa regulations. All sanctions resulting from the disregard of the laws and regulations to the participant or others shall be borne solely by the perpetrator.

6. participant unification

By registering, the participant declares: “I am fundamentally healthy and meet the requirements that the event places on me”. If the organizer recognizes that the participant is not up to the requirements of the event from the beginning or after a certain period of time, he can exclude him from further participation. A claim for reimbursement of the event fee is excluded in this respect.

7. travel cancellation

The participant can withdraw from his registration at any time. However, he must do so in writing. Withdrawal from an event becomes effective on the day on which the written notice of withdrawal is received by the organizer. In case of cancellation by the customer, the following measures apply: the deposit of the total amount (50%) paid in the course of the registration will be retained or charged.

8. withdrawal by the organizer

If the tour guide is absent due to illness or injury, force majeure hinders the event or makes it impossible (e.g. natural disasters, war, or if the routes are not passable), the minimum number of participants is not reached, or it turns out that the participant or his vehicle does not meet the requirements of the event. These are all reasons in which the organizer reserves the right to cancel an event before it starts. The participant will receive a full refund of the event fee if applicable. Further claims are excluded. The organizer reserves the right to change or cancel the schedule of the event at any time for reasons of safety and or force majeure. In case of cancellation, the fee will be refunded on a pro rata basis.

9. participant assurance

The participant confirms that he/she is the holder of a valid driving license. Even if he follows the tour guide, he rides at his own risk and peril. He participates in the event with a motorcycle that is in safe driving condition and is approved for public road traffic. The rules of the road traffic regulations as well as the legal regulations for liability and vehicle insurance of the corresponding country of travel are to be applied accordingly. The participant is responsible for respecting the road traffic regulations. He must adapt his driving to the principle of his own and others’ safety. The participant is aware of the dangers of riding a motorcycle off-road. The participant takes part in the event with proper motorcycle protective clothing.

10. compliance with instructions

The instructions of the organizer must always be followed. This also applies to its agents and assistants. The tour guide has the right to exclude the participant from the further event after a warning – without reimbursement of the participation fee – if the participant violates safety regulations or other participation requirements or if the participant endangers the other participants or the proper execution of the event. In addition, the participant can then be held liable for the damage incurred by the organizer.

11. liability

All participants waive by their signature against the organizer, as well as its representatives and helpers to claims for damages from all in connection with the event suffered personal injury, property damage or other damage. This waiver is also declared for dependents and dependents of the participant. The participant hereby further declares that he/she participates in the event at his/her own risk. The undersigned further indemnifies MX- Avantura and its employees against any claims made by third parties in connection with a damaging event caused by him. In particular, MX- Avantura assumes no liability for damage caused by improper condition of the track. We are only liable within the scope of due diligence for the conscientious preparation and execution of the booked event. Our liability is excluded or limited to the extent that damage to the participant was caused neither grossly negligent nor intentionally by MX- Avantura. Our liability is in any case limited to three times the price. If individual events are not feasible due to force majeure, MX- Avantura is entitled to create a replacement program. A price reduction is excluded in any case. Furthermore, the organizer assumes no liability for any fines/penalties that may be incurred at the event. If the participant asks the tour guide to drive his motorcycle on the event, e.g. over a difficult passage, the organizer or tour guide is not liable for any damage, e.g. in case of a fall. Any liability of the organizer for any consequences of accidents (damage to clothing, property damage, bodily injury, invalidity, as well as death) is excluded, as far as legally permissible. With his registration and waiver, the participant confirms to bear this risk himself and to be sufficiently insured for it. If a participant is injured during the event, he/she agrees to any medical treatment, recovery, transportation to hospital or other emergency services that may be required. All these measures are taken by the organizer in his best knowledge as well as in his estimation of the participant’s condition. The participant agrees to pay all related costs, unless they are covered by accident insurance or other insurance.

12. liability waiver

By registering for the event, the customer agrees to the following statement: I am fully aware of the dangers of motorcycling, especially off-road group rides. Participation in the event is at my own risk. I am responsible for my own driving and choice of route. This also applies if I follow the training or the tour suggestions of the organizer, helpers, drivers or any persons connected with the organization of the event. I agree that neither the organizer or his vicarious agents nor the site owner can be held liable for personal injury, property damage or financial loss of any kind. It is known to me that MX- Avantura is also not liable for the misconduct of other group participants. If an injury or illness prevents me from participating in subsequent day tours, I can not claim a price reduction against MX- Avantura, because the injury / illness falls within my own risk area and MX- Avantura continues to provide the services. Furthermore, I myself am civilly and criminally responsible for any damage I cause to others. I undertake to observe the traffic regulations in force in the relevant country of travel, to comply with the rules of the group tour and not to harm people or nature through my behavior in dealing with the motorcycle. I am fundamentally healthy, meet the requirements that the event places on me and have an officially registered motorcycle and a valid driver’s license. I am responsible for wearing my own protective clothing.

13. complaint

The organizer or the tour guide must be informed immediately and on the spot of any complaints giving rise to liability and these must be made within three weeks of the end of the event at the latest.

14. insurance

There is no insurance on the part of MX- Avantura!

15. rental of enduros and equipment

Motorcycles are provided by MX- Avantura upon request. The participant undertakes to treat the vehicle with care. The participant must pay for any damage caused by his own fault. Pre-existing defects must be reported. The equipment must be brought by the participant, therefore the participant is of course responsible for any damage to his own equipment.

16. data protection

The participant agrees that MX-Avantura may use, publish and pass on the photographic documentation taken for its own promotional purposes.

17. place of jurisdiction

Bosnia is agreed as the place of jurisdiction for both parties.
